Terms of service.

The rules for using Fraiwy — accounts, Essence credits, billing, what you may create, and who owns what. Written to be read: the headings mean what they say. Our Refunds & Cancellation policy and Privacy Policy are part of these terms.
1. The agreement
These terms are a contract between you and Fraiwy (“we”, “us”) — an AI creative studio at fraiwy.com, Fraiwy, operated from Vilnius, Lithuania (contact: contact@fraiwy.com). By creating an account or using the service you accept them, together with our Privacy Policy, Cookie Policy and Refunds & Cancellation policy.
2. Eligibility & your account
You must be at least 18 to use Fraiwy. Keep your credentials secure — you are responsible for activity on your account. One person per account; don’t share, sell or transfer it.
3. The service and Essence
Fraiwy gives you access to third-party and in-house AI models for generating images, video and audio. Usage is metered in Essence credits:
- New accounts receive a one-time free trial grant of Essence, valid for roughly one month — no card required, and nothing converts to a paid plan on its own.
- Paid plans include a monthly Essence allowance; unused allowance rolls over one month (up to one full allowance).
- Purchased top-up Essence never expires.
- Each generation shows its Essence cost before you run it; failed generations are automatically refunded to your balance.
Model availability, pricing in Essence, and plan features may change as the underlying providers change; material changes to a paid plan take effect from your next billing cycle, and Essence-cost changes never apply retroactively to generations you already ran.
4. Billing, cancellation and withdrawal
- Subscriptions and top-ups are billed by Stripe, monthly or yearly, at the prices shown on the pricing page. Subscriptions renew automatically until you cancel.
- You can cancel anytime in Account → Subscription — one screen, no retention flow. Cancellation takes effect at the end of the paid period, and you keep access until then.
- Upgrades apply immediately (your remaining balance carries over); downgrades apply from the next cycle.
If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal from any purchase. How it works — including the checkout choice that lets you take Essence immediately in exchange for waiving withdrawal for that top-up, the pro-rata rule for started subscriptions, and our no-fee guarantee — is set out in full in the Refunds, Cancellation & Right of Withdrawal policy, which is part of these terms and always prevails where it gives you more.
5. Your content and outputs
- You keep all rights to prompts and media you upload. You grant us the licence needed to host and process them to operate the service — nothing more. We do not use them to train our own models.
- Subject to these terms and to each model provider's terms, we assign to you all rights we hold in the outputs you generate. On paid plans you may use outputs commercially.
- Outputs stay private in your library unless you publish them to the community feed; you can unpublish at any time.
Be aware that AI outputs may be similar to outputs generated for other users from similar prompts, and that purely AI-generated works may have limited copyright protection in some jurisdictions.
6. Acceptable use
You must not use Fraiwy to create or share:
- content that is illegal where you or its subjects live, including any sexual content involving minors — zero tolerance, reported to authorities;
- intimate or sexualised imagery of a real person without their explicit consent;
- face swaps, voice clones or other likeness edits of a real person without their permission;
- content that impersonates a real person or organisation to deceive, defraud, or mislead — including political disinformation;
- content that infringes someone else's copyright, trademark or other rights.
You also must not probe, overload or reverse-engineer the service, resell access, or evade rate limits and quotas. Where law requires it — including Article 50(4) of the EU AI Act for deep fakes — you are responsible for disclosing that content you distribute is AI-generated. We may remove content or suspend accounts that break these rules — with zero-tolerance violations, immediately and permanently.
7. AI disclaimer
Outputs are generated by machine-learning models and can be wrong, biased, or unsuitable. They are not factual claims, advice, or a substitute for professional judgment. You are responsible for reviewing outputs before relying on or distributing them.
8. Intellectual property complaints and content reports
If you believe content on Fraiwy infringes your rights, email contact@fraiwy.com with the content link, proof of your rights, and your contact details. We review promptly and remove infringing content.
Signed-in users can also report any community post directly with the flag button on the post. Reported posts are reviewed, and posts reported by multiple users are hidden automatically pending review.
9. Liability
Fraiwy is provided “as is” to the fullest extent the law allows. To the extent permitted, our total liability for claims arising from the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law — including your statutory rights as an EU consumer, and liability for intent or gross negligence.
10. Termination
You can delete your account at any time in account settings — deletion locks the account immediately and permanently purges your data after a 30-day recovery window. We may suspend or terminate accounts that violate these terms; where reasonable, we will warn you first.
11. Governing law and disputes
These terms are governed by the law of the Republic of Lithuania. If you are a consumer, you also keep the protection of the mandatory consumer law of your own EU country, and you may bring disputes to the courts of your country of residence or to a national consumer dispute body — in Lithuania, the State Consumer Rights Protection Authority (vvtat.lt). 12. Changes to these terms
We may update these terms as the service evolves. For material changes we will give you notice in the product or by email before they take effect; continuing to use Fraiwy after that means you accept the updated terms.
